Esprimiamo profonda preoccupazione per l’annuncio dell’accordo tra Italia ed Albania firmato nei giorni scorsi che prevede il trasferimento forzato di migranti arrivati via mare dall’Italia all’Albania in un centro di accoglienza ed un centro di rimpatrio, con capacità di ospitare 39mila persone all’anno. L’obiettivo dichiarato dell’accordo è il rimpatrio forzato di migranti e di richiedenti asilo, senza nessuna tutela e garanzia dei diritti umani e del rispetto delle norme e delle convenzioni internazionali che vietano respingimenti e rimpatri in assenza di accordi con i paesi di provenienza e di garanzie di sicurezza.
Siamo di fronte ad una nuova versione securitaria e di esternalizzazione della gestione dei migranti e dei richiedenti protezione che, calpestando il quadro normativo europeo ed internazionale in materia di diritti umani e del diritto di asilo, scarica sui paesi fuori dall’Unione Europea, la responsabilità dell’accoglienza e del diritto d’asilo, in cambio di promesse e di aiuti economici, come è stata l’esperienza dell’Accordo tra Italia e Libia, o quello annunciato dal governo inglese con il Ruanda, impugnato dalla Corte Europea e dalla stessa corte d’appello inglese.
Come organizzazioni sindacali rifiutiamo questo tipo di cooperazione tra stati che non produce altro che nuove sofferenze a persone che già vivono in condizioni di fragilità e di vulnerabilità e che avrebbero invece bisogno di accoglienza e di canali di migrazione sicura, di accesso ad un sistema di asilo, di protezione e di inserimento sociale ed economico.
L’Unione Europea, gli stati membri e gli stati europei debbono costruire il loro futuro nella cooperazione e nella solidarietà tra i popoli, aprendo canali sicuri di mobilità per l’inserimento socioeconomico di chi intraprende il percorso migratorio o di chi cerca protezione. Come pure gli accordi bilaterali debbono essere impostati su di un partenariato orizzontale, in modo trasparente, con la partecipazione delle parti sociali, e finalizzati a creare opportunità di sviluppo sostenibile, di crescita della cooperazione e della solidarietà tra comunità locali.
Ribadiamo la nostra preoccupazione e porremo tutta la nostra attenzione a denunciare comportamenti e situazioni che violano i diritti umani e la normativa internazionale.

Deklaratë për Marrëveshjen Itali-Shqipëri
Jo shkeljes së të drejtave të njeriut të emigrantëve
Shprehim shqetësim të thellë për shpalljen e marrëveshjes mes Italisë dhe Shqipërisë të nënshkruar ditët e fundit, e cila parashikon transferimin e detyruar të emigrantëve që vijnë nga deti nga Italia në Shqipëri në një qendër pritjeje dhe një qendër riatdhesimi, me kapacitet për të akomoduar 39 mijë persona në vit.
Objektivi i deklaruar i marrëveshjes është riatdhesimi i detyruar i emigrantëve dhe azilkërkuesve, pa asnjë mbrojtje dhe garanci për të drejtat e njeriut dhe respektimin e rregullave dhe konventave ndërkombëtare që ndalojnë refuzimet dhe riatdhesimet në mungesë të marrëveshjeve me vendet e origjinës dhe të garancive të sigurisë.
Jemi përballë një versioni të ri të sigurisë dhe kontraktimit të menaxhimit të emigrantëve dhe kërkuesve të mbrojtjes, i cili, duke shkelur kuadrin rregullator Europian dhe ndërkombëtar për të drejtat e njeriut dhe të drejtën për azil, e ngarkon përgjegjësinë mbi shtetet jashtë Bashkimit Europian, pritja dhe e drejta e azilit, në këmbim të premtimeve dhe ndihmës ekonomike, siç ishte përvoja e marrëveshjes midis Italisë dhe Libisë, ose ajo e shpallur nga qeveria angleze me Ruandën, e kundërshtuar nga Gjykata Europiane dhe nga vetë Gjykata e Apelit Angleze.
Si organizata sindikale, ne e refuzojmë këtë lloj bashkëpunimi midis shteteve, i cili nuk prodhon gjë tjetër veçse vuajtje të re për njerëzit që tashmë jetojnë në kushte brishtësie dhe cenueshmërie dhe që në vend të kësaj do të kishin nevojë për pritje dhe kanale të sigurta emigrimi, akses në një sistem azili, mbrojtjeje dhe sociale dhe përfshirjen ekonomike.
Bashkimi Europian, vendet anëtare dhe shtetet europiane duhet të ndërtojnë të ardhmen e tyre në bashkëpunim dhe solidaritet mes popujve, duke hapur kanale të sigurta lëvizshmërie për përfshirjen sociale-ekonomike të atyre që hyjnë në rrugën e emigrimit ose atyre që kërkojnë mbrojtje.
Ashtu si marrëveshjet dypalëshe duhet të bazohen në një partneritet horizontal, në mënyrë transparente, me pjesëmarrjen e partnerëve socialë dhe të synojnë krijimin e mundësive për zhvillim të qëndrueshëm, rritje të bashkëpunimit dhe solidaritetit ndërmjet komuniteteve lokale.
Ne ritheksojmë shqetësimin tonë dhe do t'i kushtojmë gjithë vëmendjen denoncimit të sjelljeve dhe situatave që shkelin të drejtat e njeriut dhe ligjin ndërkombëtar.

Statement on Italy – Albania agreement: No to human rights violations against migrants
We express our deep concern at the announcement of the agreement between Italy and Albania signed a few days ago, which provides for the forced transfer of migrants arriving by sea from Italy to Albania to a reception centre and a repatriation centre, with a capacity of 39,000 people per year. The declared aim of the agreement is the forced repatriation of migrants and asylum seekers, without any protection and guarantee of human rights and respect for international rules and conventions that prohibit refoulement and repatriation in the absence of agreements with the countries of origin and security guarantees.
We are faced with a new version of securitarian and outsourcing of migration management and asylum seekers, which, trampling on the European and international regulatory framework on human rights and the right to asylum, shifts responsibility for reception and the right to asylum to countries outside the European Union, in exchange for promises and economic aid, as in the case of the agreement between Italy and Libya, or the one announced by the British government with Rwanda, which has been challenged by the European Court of Justice and the English Court of Appeal itself.
As trade unions, we reject this kind of cooperation between states, which only adds to the suffering of people who are already living in fragile and vulnerable conditions and who would instead need reception and safe migration channels, access to an asylum system, protection, and social and economic integration.
The European Union, its Member States and European countries, must build their future on cooperation and solidarity between peoples, opening safe channels of mobility for the socio-economic integration of those who embark on the migration route or seek protection. Similarly, bilateral agreements must be based on a horizontal partnership, in a transparent manner, with the participation of the social partners, and aimed at creating opportunities for sustainable development, increased cooperation and solidarity between local communities.
We reiterate our concern and will devote our full attention to denouncing behaviour and situations that violate human rights and international law.
